What Australian Companies Need to Know About EU REACH
REACH is the European Union framework for the registration, evaluation, authorisation and restriction of chemicals. The requirements that apply depend on the substance, product type, annual tonnage, intended uses and the legal role of each company in the European supply chain.
Registration
When can REACH registration be required?
EU/EEA manufacturers and importers generally need to register substances manufactured or imported in quantities of one tonne or more per year, unless an exemption or another specific provision applies.
A substance may require registration when supplied on its own or when contained in a mixture. Separate rules can also apply to substances intended to be released from articles.
For an Australian supplier, the first practical questions are which substances are entering the EU/EEA, who acts as the importer and how much of each substance is imported annually.
Only Representative
How can an Only Representative support a non-EU manufacturer?
A qualifying manufacturer established outside the EU/EEA may appoint an EU/EEA-based Only Representative to fulfil specified importer obligations under REACH for the substances and imports covered by the appointment.
This structure can centralise registration management and may allow covered EU customers to be treated as downstream users rather than importers for the relevant REACH registration obligations.
The appointment must be supported by clear substance, tonnage, customer and supply-chain records. It does not automatically replace every other regulatory responsibility connected to the product.

Registration is only one part of REACH compliance. Companies may also need to assess restrictions, Candidate List substances, authorisation requirements, Safety Data Sheet duties and communication obligations for substances in articles.
